Subject: 19082/Rezoning Study/Highland Park Neighborhood Date: Fri, 21 Sep 1990 13:56:00 -0500 RESOLUTION NO. 19082 A RESOLUTION AUTHORIZING THE CHATTANOOGA- HAMILTON COUNTY REGIONAL PLANNING COMMISSION TO CONDUCT A REZONING STUDY FOR THE HIGHLAND PARK NEIGHBORHOOD AREA, MORE PARTICULARLY DESCRIBED HEREIN, AND AS SHOWN MORE FULLY ON A MAP ATTACHED HERETO, AND DIRECTING THE OFFICE OF THE CHIEF BUILDING OFFICIAL NOT TO ISSUE CERTAIN BUILDING PERMITS FOR STRUCTURES ON PREMISES WITHIN SAID AREA OTHER THAN FOR USES PERMITTED IN AN R-1 RESIDENTIAL ZONE PENDING ACTION BY THE CITY COUNCIL ON SAID STUDY. WHEREAS, there is an inconsistency of existing land uses and the existing zoning within the Highland Park Neighborhood Area bounded on the north by McCallie Avenue, on the east by Willow Street, on the south by Main Street, and on the west by Holtzclaw Avenue, as shown more fully on a map attached hereto and made a part hereof by reference; and WHEREAS, the Highland Park Neighborhood Association would like to protect their neighborhood from any incompatible uses and retain their housing values; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That the Chattanooga-Hamilton County Regional Planning Commission be and is hereby authorized to conduct a rezoning study for the Highland Park Neighborhood Zoning Area. BE IT FURTHER RESOLVED, That the Office of the Chief Building Official is hereby directed not to issue any new building permits for new structures on premises within said area other than for uses permitted in an R-1 residential zone as described in the Zoning Ordinance of the City of Chattanooga and is further directed not to issue any building permits for conversion of any buildings on premises within said area to any use other than uses permitted in an R-1 residential zone pending action by the City Council on said study. BE IT FURTHER RESOLVED, That this resolution shall be effective only during the pendency of a comprehensive rezoning study for said area and subject to the adoption of an appropriated rezoning ordinance passed on third and final reading but it shall in no event exceed a period of one hundred twenty (120) days.
